Variances denied for Webb hotel proposal

Thirteen of the 15 variance requests for Ben Webb's fractional ownership hotel along the lake shore were turned down by the Mayville Zoning Board of Appeals.

The zoning board unanimously denied Webb's 26-foot height variance request in order to construct a 66-foot building. Other variances denied by the board included requests for additional space for patios as well as more room to build a lap pool fence and patio/deck. Side-and rear-yard extensions were also voted down by board members. Eighteen variance requests were handed to the zoning board, but members grouped the unit space variances together to vote on.

The zoning board granted a front yard variance and a 242-square-foot floor space variance to allow for the construction of 700-square-foot units on four floors.

Mary Schiller, zoning board chair, said the board followed procedure using the five determining factors for each variance request. Schiller said a number of requests were made pertaining to the dimensions of Webb's development, and each variance was carefully considered.

"We applied a balancing test as to whether the benefit to the applicant outweighed the detriment to the community," Schiller said. "What we were trying to determine was if this particular building was appropriate for this particular site under the guidance of the zoning law."

"The board had a lot of information to consider," she continued. "We all spent a lot of time considering all the information we had. All the board members worked hard on this and took it very seriously."

The height of Webb's project was one of the more talked about variance requests due to the potential lake view obstruction for village residents. A 40-foot building is permitted under zoning law, which would still have some effect on the residents' view, Schiller said.

"The height in terms of the effect the building would have on the character of the neighborhood was what we had to consider under the law," she said.

Webb is a businessman and developer who made his way back to the area from Atlanta, Georgia years ago. Webb couldn't be reached for comment, but he's said his return to the area was due to the fact that he wanted to participate in the community in a positive way.
